Andrew F. Newton is a graduate of Williams College (B.A.). Thereafter he attended the Northeastern University School of Law (J.D.). During law school, Mr. Newton clerked for a national law firm focusing on intellectual property litigation. Additionally, he clerked for a law office representing indigent clients in Austin, TX.
Mr. Newton’s practice areas include medical malpractice defense, representing medical professionals in front of licensing and regulatory agencies, and general liability. His practice also includes representing nursing home and assisted living facilities in malpractice actions and general litigation. Prior to joining Foster & Eldridge, LLP, Mr. Newton worked at a Boston based insurance defense firm where he focused his practice on representing nursing homes and assisted living facilities in all civil matters.
Mr. Newton is admitted to practice in the Commonwealth of Massachusetts; the State of New York; the State of New Hampshire; the United States District Court for the District of Massachusetts; to the United States District Court for the District of New Hampshire; the United States District Court for the Southern District of New York and the First Circuit Court of Appeals. Mr. Newton was named a Massachusetts “Rising Star” Attorney by Boston Magazine for the years 2014-2020.
Emmert v. Northeast Hospital Corp., 88 Mass. App. Ct. 117 (2015) which holds that an expert opinion to a medical malpractice tribunal is insufficient and speculative where the facts within the submitted record do not support the claim that the injury was more likely than not caused by the defendant’s negligence.
Melanson v. Swierzewski, 92 Mass. App. Ct. 1128 (2018) upholding dismissal for failure to file within the statute of limitations which did not begin to accrue when a patient was informed by an independent medical examiner that a physician's conduct was negligent.
